Terms and conditions
Introduction
This purchase is governed by the following standard terms and conditions for consumer purchases of goods over the Internet. Consumer purchases over the Internet are primarily regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act, and the E-Commerce Act. These laws grant consumers non-waivable rights. The laws can be found at www.lovdata.no
The terms in this agreement are not intended to limit the statutory rights of the consumer but to outline the main rights and obligations of both parties in connection with the purchase.
1. The Agreement
The agreement consists of these terms and conditions of sale, the information provided in the ordering process, and any specifically agreed terms. In the event of a conflict between the information provided, the specifically agreed terms shall prevail, provided that they do not contravene mandatory legislation.
The agreement is also supplemented by relevant statutory provisions regulating the purchase of goods between traders and consumers.
2. The Parties
The seller is KNIT AS, Trondheimsveien 184, 0570 Oslo, Norway.
Organization number: 928 070 476
Email: store@knit.no
The buyer is the consumer who places the order, hereinafter referred to as the buyer.
3. Price
For orders from Norway, the stated price for goods and services is the total price payable by the buyer. This price includes all taxes and additional costs. Any additional costs that the seller has not informed the buyer of before the purchase shall not be borne by the buyer.
4. Conclusion of the Agreement
The agreement becomes binding for both parties once the buyer has submitted their order to the seller.
However, the agreement is not binding if there has been a typographical or clerical error in the offer from the seller in the online store or in the buyer’s order, and the other party realized or should have realized that such an error existed.
5. Payment
The seller may demand payment for the item from the time it is dispatched from the seller to the buyer.
KNIT AS offers payment via Vipps, Klarna, Stripe, and card payment. If the buyer uses a credit or debit card for payment, the seller may reserve the purchase amount on the card at the time of ordering. The card will be charged on the same day the goods are shipped.
For payment by invoice, the invoice will be issued to the buyer upon shipment of the goods. The payment due date will appear on the invoice and will be at least 14 days from receipt. Buyers under the age of 18 cannot pay by invoice with deferred payment.
6. Delivery
Delivery is considered completed when the buyer, or a representative of the buyer, has taken possession of the goods.
If no delivery time is stated in the ordering process, the seller must deliver the goods to the buyer without undue delay and no later than 30 days after the order has been placed. Unless otherwise agreed, the goods shall be delivered to the buyer’s address.
7. Risk of the Goods
The risk for the goods passes to the buyer when they, or their representative, have received the goods in accordance with section 6.
8. Right of Withdrawal
Unless the agreement is exempt from the right of withdrawal, the buyer may withdraw from the purchase in accordance with the Right of Withdrawal Act.
The buyer must notify the seller of the use of the right of withdrawal within 14 days from the start of the withdrawal period. All calendar days are included in this period. If the deadline falls on a Saturday, public holiday, or bank holiday, it is extended to the next working day.
The withdrawal deadline is considered met if the notification is sent before the deadline expires. The buyer bears the burden of proof that the right of withdrawal has been exercised, and the notification should therefore be made in writing via the return center.
When exercising the right of withdrawal, the goods must be returned to the seller without undue delay and no later than 14 days after notification of withdrawal has been given. The buyer must cover the direct costs of returning the goods unless otherwise agreed or if the seller has failed to inform the buyer that such costs will apply.
9. Delay or Failure of Delivery – Buyer’s Rights and Deadline for Complaints
If the seller does not deliver the goods or delivers them late according to the agreement between the parties, and this is not due to circumstances on the buyer’s side, the buyer may, according to Chapter 5 of the Consumer Purchases Act, withhold payment, demand fulfillment, terminate the agreement, and/or claim compensation from the seller.
10. Defects in the Goods – Buyer’s Rights and Complaint Period
If there is a defect in the goods, the buyer must, within a reasonable time after the defect was discovered or should have been discovered, notify the seller that they wish to claim the defect. The buyer has always given timely notice if it is made within two months of discovering the defect.
A complaint can be made no later than two years after the buyer took possession of the goods. If the goods or parts of them are intended to last significantly longer than two years, the complaint period is five years.
11. Seller’s Rights in the Event of the Buyer’s Breach of Contract
If the buyer fails to pay or fulfill other obligations under the agreement or by law, and this is not due to the seller or circumstances on the seller’s side, the seller may, under Chapter 9 of the Consumer Purchases Act, withhold the goods, demand fulfillment of the agreement, terminate the agreement, and/or claim compensation from the buyer. The seller may also charge interest on late payments, debt collection fees, and a reasonable fee for uncollected goods.
12. Personal Data
The data controller for collected personal data is KNIT AS. Unless the buyer consents otherwise, KNIT AS, in accordance with the Personal Data Act, may only collect and store the personal data necessary to fulfill obligations under this agreement. The buyer’s personal data will only be disclosed to others if necessary to fulfill the agreement with the buyer or in cases prescribed by law.
13. Dispute Resolution
Complaints should be directed to the seller within a reasonable time, cf. sections 9 and 10. The parties shall attempt to resolve any disputes amicably. If this is not successful, the buyer may contact the Consumer Council of Norway (Forbrukerrådet) for mediation. The Consumer Council can be reached at +47 23 400 500 or via www.forbrukerradet.no.
The European Commission’s Online Dispute Resolution (ODR) platform may also be used if you wish to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. The complaint can be submitted here: http://ec.europa.eu/odr.
